These Terms & Conditions (“Terms”) govern your use of lovecigs.com (the “Site”) and any purchase you make from LoveCigs (“LoveCigs,” “we,” “us”). LoveCigs is based in New York City, NY, United States. By using the Site or placing an order, you agree to these Terms.

1. Eligibility: adults 21+ only

The Site and its products are for adults aged 21 or older. By using the Site and placing an order, you confirm all of the following:

  • you are at least 21;
  • buying and receiving tobacco products is lawful where you live and where the order will be delivered; and
  • you are not buying for anyone under 21.

At checkout you must confirm that you are 21 or older. We may ask for more information to confirm eligibility, and we may cancel any order that raises an eligibility concern.

2. Accounts

You are responsible for keeping your login details private, for keeping your account information accurate, and for all activity on your account. We may suspend or close accounts that break these Terms.

3. Products

Products are sold by the carton, with 10 packs per carton, unless the product page says otherwise. We aim to describe products accurately, but packaging and details can change. Product names and trademarks belong to their respective owners. LoveCigs is not affiliated with any manufacturer.

4. Orders and pricing

  • The order confirmation email confirms that we received your order. It does not mean we have accepted it.
  • We may refuse, limit or cancel an order for any of these reasons: product availability, payment problems, suspected fraud, eligibility concerns, delivery restrictions, or a pricing or listing error.
  • Prices are in U.S. dollars and can change at any time before you place an order.
  • If we cancel an order you have paid for, we refund it to your original payment method.

5. Payment

Payments are processed securely at checkout through third-party payment providers. We accept the card brands shown at checkout and in our footer. An order counts as paid only when the payment is confirmed. We do not store full card numbers.

6. Shipping

We ship from our New York, U.S. warehouse to all U.S. states except Alaska and Hawaii. We do not ship internationally. Orders are usually processed within 1 business day after payment and delivered 3–5 business days after dispatch. These are estimates, not guarantees. If we cannot ship within the time we stated, we will tell you and offer you a choice: accept the delay, or cancel for a full refund. Our Shipping Policy has the full details.

7. Your responsibility under local law

You are responsible for knowing and following the laws where you live that apply to buying, receiving and possessing tobacco products. You are also responsible for any taxes or fees that apply to your purchase.

8. Returns and refunds

Returns, cancellations and refunds are covered by our Return & Refund Policy. Returns and problem reports must be made within 7 days of delivery.

9. Prohibited use

You may not:

  • use the Site if you are under 21;
  • give false information;
  • buy for anyone under 21 or for unauthorized resale;
  • interfere with the Site’s operation or security; or
  • use the Site for any unlawful purpose.

10. Intellectual property

The Site’s content, design, name and logo belong to LoveCigs or its licensors. You may not copy or reuse them without our written permission. Third-party trademarks belong to their owners.

11. Third-party services

The Site relies on third-party services, such as payment providers and carriers. Those services follow their own terms and policies, and we are not responsible for them.

12. Disclaimer

To the fullest extent the law allows, the Site and products are provided “as is” and “as available,” with no warranties beyond those the law requires. We make no statements about the health effects of any product.

13. Limitation of liability

To the fullest extent the law allows:

  • LoveCigs is not liable for indirect, incidental, special, consequential or punitive damages; and
  • our total liability for any claim is limited to the amount you paid for the order involved.

Nothing in these Terms limits any rights you have that cannot be waived by law.

14. Indemnification

You agree to cover any claims, losses or costs that result from your breach of these Terms or your violation of the law.

15. Governing law

These Terms are governed by the laws of the State of New York. Any dispute will be heard in the state or federal courts located in New York, NY.

16. General

If any part of these Terms is found unenforceable, the rest still applies. These Terms, together with the policies they link to, form the entire agreement between you and LoveCigs.

17. Changes

We may update these Terms. Changes take effect when they are posted on this page.
